The Association fulfills Required Services (detailed in Section 5.2 of the Declaration of Covenants) and may also fulfill various Authorized Services (detailed in Section 5.3 of the Declaration of Covenants):
The Assessments levied by the Association are used in the fulfillment of required and authorized services to promote the recreation, health, safety and welfare of the residents in the Property and for the improvement, maintenance and repair of the Common Area, Common Maintenance Area, and Surface Water Management System.

The rate of the Assessment is based upon the annual budget of the community approved by the Association’s Board. As the Homeowners Association is a nonprofit organization working in service of the members (the property owners in Tarpon Bay), the Assessments are set at a uniform rate to meet the annual budgeted expenses of the Association with members billed every month.
Because the Assessment is based on the projected expenses for the calendar year and projections can vary from year to year, yearly assessment rates reflect increases and decreases in budgeted expenses. (Section 8.4 of Declaration of Covenants governs increases in assessments in Tarpon Bay)
The Annual Assessment for 2025 is $1697.89. The Annual Assessment is billed at a monthly rate of $141.49.
Assessments become due on the first (1st) day of each calendar month and incur a late fee if not paid by the 15th. On the 16th, unpaid Assessments receive a $25.00 late fee and is also subject to interest as it remains unpaid.

Upon acceptance of the deed to the Lot in Tarpon Bay, a covenant is established obligating the payment of Assessments, late fees, interest, and relevant collection costs and attorney fees by the owner of the lot. Assessments that remain unpaid are subject to interest and late fees. After a designated period (refer to the Collections Policy in the Records Library for particulars), the owner is sent a final notice informing of the balance and obligation to pay. If the balance remains unpaid, the file is forwarded to the Association’s attorney to pursue collections. After referral to attorney, the Lot in question may be subject to lien and further necessary action.

The ARB was established by the Declaration of Covenants with “right of specific approval or veto of all architectural, engineering, platting, planning, drainage and landscaping aspects of the improvement or development of any individual Residence, Lot or subdivision, tract, or parcel of land” within Tarpon Bay.
Additionally, the ARB has the authority to enter any lot to conduct inspections and issue fines for ARB noncompliance

No landscaping shall be installed or removed, nor shall any building, wall, fence, walk, dock, pool, enclosure or addition to a house or other structure, including without limitation, any garage, shed, fence, statue, yard ornament, mailbox, newspaper box or dock be constructed, erected, removed or maintained, nor shall any addition to nor any change or alteration therein be made, until the plans showing the nature, kind, shape, height, materials, floor plans, color scheme and the location of same shall have been submitted to and approved in writing by the ARB .
